Don’t Be a Sitting Duck on Data Privacy

Did you know that on January 1st several new data privacy laws went into effect? Most brands have no idea they're already exposed to the consequences.

Several states rolled out updated privacy laws this year, giving consumers stronger rights to control how their data is sold or shared. Many states now require businesses to recognize universal browser signals that apply a user’s privacy preference across every website they visit. Some states have also added stricter limits on the use of minors' data for targeted advertising.
Here's where it gets real for businesses: This isn't just a "certain states" problem. If your website collects visitor data through tools like Google Analytics, Meta Pixel, or most advertising platforms, you may already fall within the scope of these regulations. And it doesn’t matter where your company is headquartered. If visitors from these states land on your site, these laws can apply to you.
Here's the uncomfortable truth. If your site doesn't have a clear process in place for consumers to opt out of the sale or sharing of their data, you may already be out of compliance. And that can make you a target. We are seeing bad actors systematically scanning websites looking for brands that haven't caught up. They find a gap, they call a lawyer, and they sue. It's organized, it's intentional, and it's happening more often than most companies realize.
The good news? This is all fixable, and it’s easier than you'd think. But waiting for a legal notice to land in your inbox is not a strategy.
We suggest you take 10 minutes today to check your own situation. Review your website's legal policies and make sure your house is in order.
